Reservation Terms of Agreement

• RESERVATION, PRICING, &  PAYMENT

1. 1. Payment is required at the time of booking in order to confirm and hold your reservation. 
   2. Pricing for Packages vary by size and availability. 
      1. Pricing starts at $115  plus tax for a BASIC PACKAGE.
      2. Pricing starts at $130 and $150  plus tax for a THEME PACKAGE.
      3. Pricing starts at $130 and $150  plus tax for most SPECIAL OCCASION PACKAGES.
      4. Pricing starts at $150 for GRADUATION PACKAGES.
      5. Pricing starts at $150 plus tax for CUSTOM STANDARD PACKAGES.
      6. Pricing starts at $190 plus tax for CUSTOM PREMIUM PACKAGES.

1. PACKAGE DETAILS/INVENTORY  
   1. Packages listed with pictures are only examples of what you will receive.  We do our best to accommodate colors and specific signs yet inventory changes regularly.  Packages are based on size and number of letters/characters/flair in a set including name.  We can only guarantee the amount of items you will receive in your package not the specific characters or items.  
      1. Basic- less than 24 characters
      2. Theme Packages- will have some of the themed characters and/or colors selected at booking.
      3. Premium Packages- 25 + characters usually including one name spelled out
      4. Custom Packages- To Be Determined based on the custom quote.

• RUSH ORDERS. 

1. 1. Rush orders are any orders less than 72 hours of delivery day.  Rush orders and same day orders may be accommodated with the following conditions:
      1. Based on available inventory
      2. Rush fee may apply
   2. Orders placed within 72 hours of requested event day are not guaranteed
   3. Order will be refunded if YARD PARTY GRAM Representative in your Primary area is unable to complete the rush order

• DELIVERY, SET UP AND PICK-UP

1. 1. Delivery within 15 miles of the Primary Service Area by zip code is included.  For deliveries outside the Primary Service Area, an additional delivery fee will be calculated and added to the cost at the time of checkout.  The delivery rate outside of the Primary Service starts at $20 and $1 per additional mile.
   2. Deliveries occur on the date you select for “Date of Delivery” when placing an order. YARD PARTY GRAM  typically delivers in the mornings between 6:00 am and 11:59 am and evenings between 5:00pm and 11:00pm with some deliveries happening after midnight during peak demand.
   3. Pick-ups usually occur 24 hours after the on the date you select for delivery when placing an order. YARD PARTY GRAM  picks up in the mornings between 6:00am and 11:59am and evenings between 5:00pm and 11:00pm
   4. In some cases you may want delivery/set-up and take down within the same day. We will always do our best to accommodate client requests.

•  YOUR RESPONSIBILITIES

1. 1. All Yard Party Gram greetings are meant to be pleasant surprises.  Please remember to notify the homeowner that they will be receiving the greeting within 24 hours of delivery date so that they can make arrangements. 
   2. Please water the lawn at least 24 hours prior to delivery. If the ground is too hard, our team may be unable to install your YARD PARTY GRAM display.
   3. Ensure someone at the delivery location is aware a representative of YARD PARTY GRAM  will be on the property on the delivery and pick-up dates.
   4. Arrange for scheduled lawn service crews to come either before or after the display period.
   5. For our team’s safety, please ensure all pets are secured inside the home, business, or fenced-in area during delivery and pick-up times.
   6. We do our best to successfully surprise your loved ones. During the delivery time, please help us by keeping pets indoors, limiting barking dogs, and closing blinds.
   7. Prior to delivery, turn off sprinkler systems.
   8. Do not allow children or others to play on or around the Yard Card displays as the display will not support the weight of a child or an adult leaning, sitting, playing with, or otherwise disturbing the display.
   9. Do not remove or relocate the Yard Cards as damage may occur from improper handling.
   10. Do not throw away any part of the Yard Card display.
   11. Do not use lawn trimmers and/or allow any mowing debris to be blown on the yard cards.  Grass can stain and damage the signs.
   12. Do not attach any object, such as balloons, to the Yard Card display as damage may occur.
   13. Please take pictures and tag @YARDPARTYGRAM on your social media platforms.  

• DAMAGES AND FEES

1. 1. You will be responsible for damaged or missing Yard Cards at a rate of $25.00 per staked item.
   2. You are responsible for damages to the Yard Cards caused by pets, lawn crews, residents, visitors, or others while the Yard Card is on display.

You will be invoiced for any damaged or missing Yard Cards and required to pay the invoice within 30 days.

• INCLEMENT WEATHER POLICY. 

• In the event of inclement weather, we may not be able to set up your Yard Party signs. Weather related delays in installation will be communicated as soon as possible. Inclement weather includes  lightning/thunderstorms, rain, snow, high winds and any other Act of God that would put us or our lawn display in harm’s way. We will first attempt to reschedule; if rescheduling is not possible you will be given a full refund.  In most circumstances, our team members will be flexible, however, greeting times cannot be extended due to weather related delays.

1. RIGHT TO SERVE/DECLINE SERVICE.
   1.  Yard Party Gram reserves the right to politely decline orders that are political, controversial, lewd, disrespectful or that do not fit the celebratory nature of our business. Yard Party Gram locations are often independently owned and revising requested wording or declining orders is done so at the local Representative or Owner’s discretion. If an order is declined, a full refund will be given.
   2. We respectfully reserve the right to decline a delivery area that we feel may be unsafe for our representative. We will contact you if this situation arises.

• RELEASE AND WAIVER OF LIABILITY

I release and forever discharge YARD PARTY GRAM LLC, its affiliates, members, agents, representatives, successors, and assigns, from any injury or property damages that may arise during the Yard Card display period. Yard Party Gram LLC against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney’s fees and costs. 

• CANCELLATION AND REFUND POLICY

1. 1. If you need to cancel your reservation, you must notify Yard Party Gram by 9:00am the day 72 hrs prior to the scheduled Date of Delivery to receive a 50% refund of your order fee.
   2. Cancellations requested after 9:00 am within 72 hours of the day scheduled Date of Delivery but before delivery and display will not receive a refund.
   3. No refunds will be administered due to undeliverable conditions:
      1. No refunds will be given due to the client giving us the wrong address.
      2. No refunds will be given due to the homeowner requesting us to remove the lawn display.
      3. No refunds will be given due to being denied access to a gated community.
      4. No refunds will be given due to any animals that prevent the display from being set up.
      5. No refunds will be given for circumstances that prevent us from setting up the display, that are out of our control.

• FORCE MAJEURE

1. 1. Yard Party Gram will not be responsible for delivery in turbulent weather or if delivery is delayed or prevented by reason of circumstance beyond reasonable control, including without limitation fire, natural disaster, earthquake, accident or other acts of God (“Force Majeure”). In the event of turbulent weather or other Force Majeure conditions, Yard Party Gramwill contact you as soon as practical to make alternate delivery arrangements.

• ENTIRE AGREEMENT

1. 1. It is agreed that there is no representation, warranty, collateral agreement, or condition affecting this Agreement except as expressly provided in this Agreement.

• GOVERNING LAW

• This Agreement will be governed by and construed in accordance with the laws of the State in which the delivery is made. .

• SEVERABILITY

• In the event that any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of the Agreement.

• WAIVER 

• The waiver by either Party of a breach, default, delay or omission of any of the provisions of this Agreement by the other Party will not be construed as a waiver of any subsequent breach of the same or other provisions.

BY PLACING AN ORDER, YOU ARE AGREEING TO ALL YARD PARTY GRAM’S COMPANY TERMS, CONDITIONS AND POLICIES
